Terms and Conditions:

BY MAKING PAYMENT ON ANY EZ TRADING COMPUTERS/TULCAN ENTERPRISES LTD. PRODUCTS OR SERVICES, YOU ACCEPT AND AGREE TO BE BOUND BY THIS AGREEMENT:

1. INTRODUCTION This agreement ("Agreement") contains terms and conditions applying to your purchase with EZ Trading Computers/Tulcan Enterprises LTD, ("EZ TRADING COMPUTERS") products and services ("Product"). "We/Us/Our" means the EZ Trading Computers/Tulcan Enterprises LTD, owners, employees, affiliates and contractors. "Website" means the website located at https://eztradingcomputers.net and or any other related URL and all associated websites and micro sites of www.eztradingcomputers.net. "You/Your" means you as a user of the Website and Product purchaser/buyer. "Warranty" refers to the EZ TRADING COMPUTERS Limited Warranty, which is published on the Website at https://eztradingcomputers.net/pages/warranty and is also provided with your computer. Please review the Limited Warranty before purchasing.

ORDER OF PRECEDENCE: This Agreement governs the terms of sale — pricing, payment, shipment, cancellation, and returns. The Limited Warranty sets out warranty coverage, exclusions, and service procedures in full, and both documents are maintained in alignment. In the event of a direct conflict between this Agreement and the Limited Warranty, the terms of this Agreement control as to the conflicting term only; all other terms of the Limited Warranty remain in full force and effect.

2. GOVERNING LAW AND DISPUTE RESOLUTION THIS AGREEMENT AND ALL SALES THEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF FLORIDA, WITHOUT REGARD TO PRINCIPLES OF CONFLICT OF LAWS. Any dispute arising out of or relating to this Agreement or any Product purchased under it shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, with the arbitration seated in Broward County, Florida. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in the small claims court of Broward County, Florida instead of arbitration if the claim qualifies for that court. Arbitration shall be conducted on an individual basis only. You and EZ TRADING COMPUTERS each waive any right to bring or participate in a class, collective, or representative action. Nothing in this section limits any right you may have under the consumer protection laws of your state of residence that cannot be waived by agreement.

3. PRICES AND TAXES Prices shown are exclusive of sales, use, excise, and similar taxes. We collect and remit sales tax in every state where we are required to do so. Any applicable tax is calculated at checkout based on your shipping address and is itemized on your invoice. If any additional tax, fee, or charge is later imposed by a governmental authority on, or measured by, the transaction between EZ TRADING COMPUTERS and you, you will be responsible for that tax, fee, or charge. In the event that EZ TRADING COMPUTERS is required to pay any such tax, fee, or charge at the time of a sale or thereafter, you will reimburse EZ TRADING COMPUTERS therefore.

4. SHIPMENT, DELIVERY, AND SHIPPING DAMAGE We will ship your order within the timeframe stated at the time you place your order, or, if no timeframe is stated, within 30 days. Because our systems are built to order, stated build and ship dates are estimates. If we cannot ship within the applicable timeframe, we will notify you and you may either consent to the new shipping date or cancel your order for a full refund. Refunds for orders we cannot ship are issued promptly to the original method of payment. EZ TRADING COMPUTERS will ship by a carrier of their choice (generally FedEx Ground or UPS).

Shipping insurance and damage claims. We insure every shipment we send to you, and we will file and manage any shipping damage claim with the carrier on your behalf.

Inspect your order on arrival. It is Your responsibility to report any shipment issues or problems by calling 800-387-5250 or emailing eddiez@eztradingcomputer.net within the applicable window below:

  • Visible shipping damage — damage you can see on the shipping box or on the system without setting it up: within three (3) calendar days of delivery.
  • Concealed shipping damage — damage discovered when you set the system up, such as a component knocked loose in transit: within seven (7) calendar days of delivery.
  • Missing or incorrect items: within seven (7) calendar days of delivery.

Please photograph the damage before repacking. Take photos of the shipping box from all sides (including any visible damage), the packing materials as you found them, and the affected component or system, and send them with your claim. Photo documentation is what the carrier requires to approve a claim and helps us resolve your issue faster.

If the damage can be repaired on-site, we will send parts and instructions at no cost to you. If it cannot, we will arrange to return the system to us and ship it back to you at our expense. After the applicable window above, we are unable to file a carrier claim and responsibility for loss or damage passes to You. On shipments you send to us, you are responsible for proper packaging, insurance, and tracking.

5. CANCELLATIONS You may cancel an order at no charge at any time before it ships. Once an order has shipped, a cancellation is a refusal of delivery rather than a return of a Product you have evaluated, and we incur freight in both directions on a system built to your order. All cancelled orders that have already shipped will incur a cancellation fee of 10%. This is to cover the shipping and handling costs of any merchandise returned to us because you simply changed your mind. This is separate from our 100% Risk-Free Money Back Guarantee in Section 12, which applies once you have taken delivery, set the computer up, and decided it is not right for you.

6. PAYMENT You agree to make the payments set forth in the invoice for the Products. Unless otherwise agreed by EZ TRADING COMPUTERS, payment must be received in full prior to shipping out the Product to You. This includes any time delays that there may be with money orders, cashier's checks, personal checks, business checks, bank wire transfer or credit card transactions. If your check is returned, EZ TRADING COMPUTERS will charge $100 plus costs and bank fees.

7. CANADA AND INTERNATIONAL Canada: Computers sold to customers in Canada carry the full EZ TRADING COMPUTERS Limited Warranty, with one difference in shipping terms: during the first 30 days we cover all warranty shipping costs both ways; after 30 days, we pay to ship replacement parts to you, and you pay to return the replaced part to us, including any customs or brokerage fees. Please see the Limited Warranty for complete details.

Outside the Continental United States and Canada: International orders are an "at-will" type order and all sales are final. EZ Trading Computers will do our best to support our warranty in your country; however, it is impossible for us to pay for shipping of components (or the rare instance of an entire computer) internationally. Warranty service outside the Continental US and Canada is therefore limited to (a) helping you obtain an RMA from component manufacturers in your region, (b) providing telephone technical support (in English only) to help you install the component and resolve your issue, and (c) full warranty service if you pay shipping and customs fees in both directions. Once EZ TRADING COMPUTERS delivers the goods to the freight/shipping company, the title of the goods and products as well as the risk of loss or damage will transfer to the purchaser. We cannot guarantee successful delivery or working status once it leaves our facilities in the United States. Purchaser is responsible for all customs/taxes/duties/fees associated with receiving the goods inside your country.

8. SOFTWARE AND INTELLECTUAL PROPERTY All software contained within the Product which is provided to You is subject to the license agreement that is part of the package or shown during installation of the software. You agree to be bound by any such licenses by opening the package or installing and/or using the software. Any warranty related to such software shall be provided solely within such license agreement. EZ TRADING COMPUTERS hereby retains for itself all other rights, title, and interest in and to all intellectual property in the Products sold and any products or software or other deliverable created during performance of the services, including without limitation, worldwide copyright, trade secret, patent, trademark, and any other proprietary rights. Software purchases from EZ TRADING COMPUTERS are final once opened, registered, or installed, whether part of the Product or purchased separately, and are not eligible for exchange or refund.

9. WEBSITE The Website is subject to constant change. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension or withdrawal of all or part of the Website. We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website. We may alter these terms and conditions from time to time. Changes apply to orders placed after the revision date shown on this page and do not change the terms of an order you have already placed. It is your responsibility to review the current terms before ordering. We are not responsible for the availability of any external sites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content (including unrepresentative or defamatory content) of any third party websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offense caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external sites or resources. We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to, issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Website). You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

COPYRIGHT: All of the images and text found on the Website have copyright laws within them. You or any party that uses the Website will not have access and cannot download any of the information or images. If you want to download the articles for personal use or for any other reason, you may request approval to eddiez@eztradingcomputer.net. You can link directly to the articles found on the Website, but you cannot use any part of the articles for any reason, whether personal or commercial without authorization from Us.

10. LIMITATION OF LIABILITY The limitation of liability under no circumstance shall EZ Trading Computers/Tulcan Enterprises LTD, be liable for (A) Any special, incidental, indirect, or consequential damages, including but not limited to physical injury, loss of data or loss of profits, even if EZ Trading Computers/Tulcan Enterprises LTD, knew or should have known of the possibility of such damages, (B) any claim made by a third party or made by You for a third party, AND (C) any amount of damages above the aggregate dollar amount paid by You for the Products purchased from EZ Trading Computers/Tulcan Enterprises LTD,. This limitation of liability applies whether damages are sought as a tort claim (including negligence and strict Product liability), a contract claim, or any other claim and notwithstanding any failure of essential purpose of any limited remedy. IF YOU ARE HAVING TECHNICAL ISSUES WITH YOUR TRADING COMPUTER DO NOT TRADE WITH IT AND CALL TECHNICAL SUPPORT IMMEDIATELY. EZ TRADING COMPUTERS IS NOT RESPONSIBLE FOR LOSSES THAT COULD OCCUR DUE TO COMPUTER FAILURE. You are responsible for maintaining backups of all data, trading platform configurations, and software licenses. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This Agreement gives you specific legal rights, and you may also have other rights which vary from state to state.

11. WARRANTY You agree and are bound to every aspect of the EZ TRADING COMPUTERS Limited Warranty that you purchased while making an order, published at https://eztradingcomputers.net/pages/warranty:

  • Desktop computers: five (5) year limited parts and labor warranty
  • Laptop computers: one (1) year limited parts and labor warranty
  • Lifetime technical support is provided on all desktop and laptop computers, for as long as you, the original purchaser, own the system

All warranty periods begin on the date you receive your system. The Limited Warranty sets out coverage, exclusions, and service procedures in full. In the event of a direct conflict between this Agreement and the Limited Warranty, this Agreement controls as to the conflicting term only.

We stand behind every system we build and will always work in good faith to resolve your issue. We reserve the right to cancel warranty coverage, after written notice, only in these circumstances:

  • Abusive, threatening, or harassing conduct toward our staff
  • Repeated refusal to follow reasonable diagnostic or repair procedures, making it impossible for us to service the system
  • Fraud or material misrepresentation in connection with a warranty claim
  • An unresolved chargeback or payment dispute on the invoice for the system or service in question (coverage is reinstated if the dispute is resolved in a manner that makes us whole)

Cancellation under this section applies prospectively and does not affect repairs already completed.

12. 100% RISK-FREE MONEY BACK GUARANTEE: EZ TRADING COMPUTERS offers a 100% Risk Free Money Back Guarantee. If, after you have taken delivery and completed setup, you are unhappy with your EZ Trading Computer for any reason, EZ Trading Computers will refund 100% of your purchase price (computer only) plus return shipping cost within the first 14 days from delivery date. Terms: YOU MUST CALL US TO ACT ON THIS OFFER and allow us to schedule a carrier pickup at the original delivery location. Any computer returned to us without authorization will be charged a 30% restocking fee.

IMPORTANT PACKAGING REQUIREMENT: PLEASE KEEP ALL BOXES. To be eligible for any refund, all returns MUST include the original box and all packaging materials the computer was shipped with. The computer MUST be packed in ALL original shipping boxes, double boxed with appropriate packing materials, and ALL original contents of the box MUST be returned. If you do not have the original boxes and packaging materials, you are not eligible for any refund.

Guarantee eligibility and return timeline:

  • Days 1–14 from delivery: 100% refund of the purchase price (computer only) plus return shipping, as described above.
  • Days 15–30 from delivery: returns are accepted with a 30% restocking fee; you pay return shipping.
  • After 30 days: we do not accept returns.

This offer is only valid on the standard computers offered on our website and only on computers sold in the continental United States. This offer is not valid on any Customized EZ Trading Computers. All fully custom ordered machines will have a 30% restocking fee if returned. This offer is NOT valid on monitors, monitor stands and/or accessories. Monitors and Accessories are returned at your expense and are serviced through their respective manufacturers. Refunds are issued to the original method of payment. Original shipping & handling charges will not be refunded, including our actual shipping cost when FREE SHIPPING is offered.
